The Dean said it's up to the teacher and she's sorry she can't do anything about it. I'm going to have my friend back me up, if not, I already asked if I can just switch teachers since the same class with another teacher has some empty spots. I doubt it will happen though. This [expletive] just [expletive]ed me over.

I apologized and didn't make a scene. I told him I was texting my mom checking on her because she was sick (has leukemia) and he told me he doesn't care and I didn't get the message from him when he moved my seat. But before he kicked me out, he said next time I'm going to drop you. I e-mailed apologizing, but then he said he changed his mind and is dropping me. Even though he sees others texting and talking, he singled me out. Basically, I'm [expletive]ed and he screwed me over. And I'm going to [expletive] his rating up on rate my professer.
