Isnt there a clause somewhere that if they dont make the playoffs they get the pick? 

 

They were saying on Mike and Mike this morning that the league should step in and give them the 1st rounder since the trade has went so off the wall for them this year. 

 

Not sure if that ever happened in the past.

Pretty sure Philly's pick is protected this year, and they won't make the playoffs unless there's a big push in March (doubt that).

The 2013 pick is tied up with a trade involving the Heat, not the Bynum trade.

If they miss the playoffs they get the pick. So yes, they get the pick.
